Biden / Austin DoD: DEI as department policy
The JAG apparatus sat inside a force-wide project — an extremism stand-down, equity plans, and a DEIA strategic frame that tied group outcomes to readiness (C01; C03).
Public-source context, not Army FOIA evidence. Every item below links to its public source.
Within weeks of taking office, SecDef Austin ordered commanders and supervisors to hold a one-day stand-down on extremism in the ranks within 60 days (C01). That memo covered the oath, impermissible behaviors, and reporting — including "extremist or dissident ideologies." It was culture as a command task, not yet the DEI brand.
The DEI brand came through the Equity Action Plans. Under EO 14091, DoD's 2023 plan said it would "Advance gender diversity, equity, and inclusion by removing barriers to the recruitment, development, retention, and advancement of women in DoD," and that advancing equity "makes the Joint Force a stronger and more resilient fighting force" (C05). The 2022 plan under EO 13985 used "advancing equity" heavily on the procurement side (C04). Service manpower officials then sold diversity as combat power in Congress: the Chief of Naval Personnel told HASC that "Navy actively includes all perspectives and harnesses the creative power of diversity, accelerating Navy's warfighting advantage and lethality" (C26); the Space Force personnel chief's FY22 written testimony: "The Space Force is committed to recruiting and retaining a diverse force" (C27).
That is the soft entry. Once the Department measures success by demographic representation, individual merit becomes a competitor, not the standard. EO 14185 §1 named the problem in plain English: DEI preferences "undermine leadership, merit, and unit cohesion, thereby eroding lethality and force readiness" (S14). The companion orders — EO 14151 (S08), EO 14173 (S10), and the SecDef memo "Restoring America's Fighting Force" (S16) — tore down the apparatus. The JAG FOIA file shows how one Corps built the plumbing while that department policy ran.
